These terms ("Terms") govern your use of the website at timspaintrepair.com and any service you receive from Tim's Perfect Painting ("we," "us," "our," or "Contractor"), a sole proprietorship owned and operated by Tim Herrin in Wake County, North Carolina. By requesting an estimate, hiring us, or using this site, you ("you," "Customer") agree to these Terms.

1. Services we provide

We offer residential and light commercial painting services in the Raleigh–Durham–Chapel Hill triangle of North Carolina. Services include interior painting, exterior painting, cabinet refinishing, drywall and sheetrock repair, pressure washing, and deck restoration. The exact scope of any project is set by the written estimate we email you and which you confirm in writing or by signature.

2. Estimates and pricing

All estimates are provided in writing after an on-site walk-through. The cost estimator on this site is a non-binding educational tool only. Any number it displays is an approximation and is not a contractual offer.

3. Scope of work and change orders

The written estimate defines what is included in the project: rooms, surfaces, paint product(s), number of coats, prep work, and timeline. Anything not listed is not included.

If you would like to add work, change a color after primer has been applied, or otherwise alter the scope mid-project, we will provide a written change order describing the added work and additional cost. Work on the change order begins only after you accept it.

4. Materials

Unless otherwise specified, we provide all paint, primer, caulk, drop cloths, masking, and equipment. If you wish to supply your own paint, we will note that on the estimate; in that case we cannot warrant the finish or longevity of the coating.

7. Workmanship warranty

We warrant our workmanship for two years from the date of project completion. If paint peels, blisters, or fails through no fault of yours or of conditions outside our control, we will repaint the affected area at no additional charge for materials or labor.

8. Limitation of liability

To the maximum extent permitted by North Carolina law, our total liability for any claim arising out of or related to a project is limited to the amount you actually paid us for that project. We are not liable for incidental, consequential, special, indirect, or punitive damages, including lost rent, lost business income, or emotional distress, even if we were advised of the possibility of such damages.

9. Insurance

We carry general liability insurance covering our work. If a claim arises from damage caused by our crew during a project, contact us immediately and we will work with our insurer to resolve it. Proof of insurance is available on request.

10. Cancellation and rescheduling

You may cancel a project before work begins at no cost. Once materials have been purchased specifically for your project, you may be responsible for the material cost. Once work has started, you owe the prorated value of work completed plus materials.

We may reschedule due to weather (especially exterior projects), unsafe conditions, or unforeseen circumstances. We will give as much notice as possible and propose a new start date.

We may photograph completed work for our portfolio, website, and social-media promotion. Photographs will not identify your address or any personally identifying detail without your prior written consent. If you would prefer no photographs of your project, simply let us know in writing before work begins.

12. Force majeure

Neither party is liable for delay or failure to perform under these Terms due to causes beyond reasonable control, including severe weather, fire, flood, hurricane, pandemic, civil disturbance, government order, or interruption of supply chains. The affected party will use reasonable efforts to perform as soon as the cause is resolved.

13. Governing law and disputes

These Terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-law principles. Any dispute will first be addressed through good-faith discussion between you and Tim. If a dispute cannot be resolved informally, the parties agree to attempt mediation before bringing a lawsuit. Any litigation arising under or related to these Terms will be filed in the state or federal courts located in Wake County, North Carolina, and both parties consent to the exclusive jurisdiction of those courts.

14. Severability

If any provision of these Terms is held unenforceable, the remainder will continue in full force and effect.

15. Entire agreement

These Terms, together with the written estimate you accept and any signed change orders, form the entire agreement between us about your project, and supersede any prior oral or written discussions.
